摘要随着数字信息的迅猛发展,非法获取网络虚拟财产的行为呈现高发趋势,需要严加规制和有效应对。网络虚拟财产具有无形性、不可触摸性的特点,与现实世界的普通财物有着较大差异,存在诸多刑法定性难题。文章通过引入中国裁判文书网643件刑民判决书,全面剖析非法获取网络虚拟财产的刑法定性现状。非法获取网络虚拟财产存在行为类型多样、刑民定性恣意、罪名选择困难等问题。溯源非法获取网络虚拟财产行为纷乱定性的原因,主要源于网络虚拟财产与刑法财物的同质转换、财产类犯罪罪名与计算机类犯罪的罪名选择,以及对兑换价值和成本价值的数额认定等困境。针对这些困境,应紧密围绕犯罪概念,从社会危害性剖析非法获取网络虚拟财产的刑法性质,并通过明确非法获取网络虚拟财产的刑民界分标准、罪名认定标准、犯罪数额认定标准予以类型化规制。 With the rapid development of the information and digital age,the theft of network virtual property occurs frequently,which needs strict regulation and effective response.Network virtual property is intangible and untouch⁃able,which is quite different from ordinary property in the real world,and there are many difficulties in the qualitative behavior.This paper introduces 643 criminal and civil judgments of China judicial document network,and comprehen⁃sively analyzes the overall qualitative state of stealing online virtual property.There are many problems in stealing on⁃line virtual property,such as various types of behavior,arbitrary criminal and civil characterization,difficult crime se⁃lection and so on.The reasons for the confusion and qualitative nature of the behavior of tracing to the source theft of network virtual property mainly focus on the dispute whether the network virtual property can be equal to the real prop⁃erty,and thus fall into the dilemma of the choice between crime and non crime,property crime and computer crime.In view of these difficulties,we should closely focus on the typed regulation of the behavior of stealing network virtual property itself,that is,by clarifying the behavior types of non crime,property crime and computer crime.
