摘要
用能权交易制度是我国能源要素市场化改革的重要制度安排。目前,我国用能权交易市场尚处于探索阶段,存在着用能权的权利属性界定不明与初始分配规则不一,进而导致用能权交易制度开展的理论基础不彰与整体建构失调;用能权交易市场呈现出市场活跃度低、与其他环境权益市场交叉等问题。由此,需完善用能权一级市场与二级市场的法律规范建设,为全面推进用能权交易市场提供制度保障;应以用能权的权利客体(能量)为逻辑基点展开思考,确认用能权的准物权属性;在明确其权利属性的前提下,应实现用能权初始分配模式科学化发展;应探索用能权交易主体的扩围,开拓多种交易形式,不断盘活市场动力;应确保用能权与碳排放权交易市场的协同共建,在解决重复计算的基础上不断探索两权市场的制度合力建设,共同作用于“双碳”目标的实现。
The trading system of energy consumption permits is an important institutional arrangement for the market-oriented reform of energy factors in China.At present,the trading market of energy consumption permits is still in the exploratory stage,and there are problems such as the unclearly-defined rights attributes of energy consumption permits and the inconsistent initial allocation rules which further result in the inconspicuous theoretical basis and ill-balanced overall construction of implementing the trading system of energy consumption permits,low activity of the trading market of energy consumption permits,and intersections with markets of other environmental rights and interests,etc.Therefore,it is necessary to improve the legal regulations construction concerning both primary and secondary markets of energy consumption permits,and provide institutional guarantees for the comprehensive promotion of the trading market of energy consumption permits.The quasi-property attributes of energy consumption permits should be confirmed based on the rights object(energy).The scientific development of the initial allocation model of energy consumption permits should be realized on the premise of clarifying its rights attributes.It is necessary to explore the expansion of the trading entities of energy consumption permits,develop a variety of trading forms,and constantly activate the market momentum.It is also necessary to ensure the synergy and co-construction of trading markets of the energy consumption permits and carbon emission.The institutional synergy of the two markets should be explored through the solution of double-counting so as to jointly contribute to the realization of the goals of carbon peak and carbon neutralization.
