摘要
人工智能的快速发展极大地改变了人类的创作方式,同时人工智能生成物的版权问题也给我国的《著作权法》体系带来了巨大的冲击。对于人工智能生成物是否具有可版权性,最重要的是看人工智能生成物是否符合我国《著作权法》意义上的作品。作为人类创作的辅助工具,人工智能与人存在本质上的不同,无法拟制为法律上的主体。本研究认为,对人工智能生成物的版权归属制度进行设计不仅要遵循内在的法律逻辑,同时也要兼顾各方的利益。创作者模式和投资者模式都具有可行之处,在一般场合,将人工智能生成物归属创作者,当人工智能生成物的作品属于法人、雇佣、委托作品时,适用投资者模式则更为合理。
Artificial intelligence has greatly changed the way of human creation.At the same time,the copyright issue of AIgenerated works has also posed a huge challenge to the“Copyright Law”of China.The determination of the copyright mainly depends on whether the AI-generated works conform to the definition of“works”prescribed in the Copyright Law.As an auxiliary tool for human creation,AI is fundamentally distinct from human beings and cannot be recognized as legal subjects.This study argues that the design of the copyright attribution system for AI-generated works should not only follow the internal logic,but also take into account the interests of all parties.In this regard,both the creator model and the investor model are feasible.In general,it is more reasonable to attribute the AIgenerated works to the creators,and to apply the investor model when the works fall into the categories of legal persons,employment or commissioned works.
