摘要随着体育赛事数据的市场化开发与应用,如何保护中国的赛事组织者的赛事数据权益成为一个重要的问题。运用文献研究法、比较分析法等,分析了美国、澳大利亚和欧洲一些国家对赛事组织者的赛事数据权益法律保护的一些案例,并从中得出启示。由于赛事组织者的赛事数据权益保护有一定的特殊性,一般性的数据保护法律与法规或体育赛事权益保护机制都难以从法律层面对赛事组织者的赛事数据权益进行全面的保护。即无论是美国的“数据盗用制度”或是欧洲一些国家的“数据库权”,还是澳大利亚在赛事数据权益保护法律纠纷案中援引《版权法》与“家宅权”。对中国而言,通过立法程序保护赛事组织者享有的赛事数据权益,解决当前中国赛事组织者因保护赛事数据权益而引发的法律纠纷不失为一种可行的手段,应结合中国体育行业的大数据产业发展现状,在《中华人民共和国体育法》再次修订时增加“中国赛事组织者的赛事数据权益保护”条款。 With the market development and application of sports event data,how to protect the event data rights and interests of event organizers has become an important issue.Using literature research method and comparative analysis method,the legal practices of event organizers in the United States,Australia and some European countries to protect event data rights and interests are discussed and some enlightenments are drawn.Due to the specificity of event data protection for event organizers,general data protection laws or event rights protection mechanisms,such as the“data theft regime”in the United States,the“database rights”in Europe,the dispute over the protection of rights and interests of event data cited from Copyright Act and the“home ownership rights”in Australia,are difficult to protect the rights of event organizers.In China,it is a feasible means to give event organizers the rights of event data through legislative procedures and solve the disputes caused by the protection of event data rights by Chinese event organizers.It is necessary,based on the development status of big data technology in China’s sports industry,to add a provision on“protection of event data rights of event organizers”in the amendment of the Sports Law of the People’s Republic of China to properly deal with the conflicts between parties related to event data rights.
