摘要
法治背景下,社会转型的过程也是权利转型的过程,终身学习社会的建立需要相应的权利转型予以保障支持。为适应社会经济多元发展和高质量复合型人才变革境遇,学习已不再局限于传统教育框架内,由此导致教育与学习的关系发生了根本变化。在此过程中,受教育权作为接受权,其实体权利内容和保障条件等局限性愈发凸显。一种超越了"接受教育"理念,由学习自由权、以受教育权为核心的学习条件保障权、个体的发展权构成的综合性权利,即学习权,成为建立终身学习社会的基石。
Under the background of the rule of law, the process of social transformation is also the process of right transformation. The establishment of lifelong learning society needs to be guaranteed and supported by corresponding rights transformation. Lifelong learning is increasingly intertwined with human production and life. In order to adapt to the pluralistic development of social economy and the reforming circumstances which high-quality compound talents are faced with, learning should no longer be limited to the framework of traditional education, resulting in a fundamental change in the relationship between education and learning. In this process, the right to education equals the right of acceptance while the limitations of the content and guarantee conditions of its substantive rights are becoming more and more prominent. Beyond the concept of " receiving education", a comprehensive right composed of the right to learn freely, the right to guarantee learning conditions with the right to education as the core and the right to individual development, namely, the right to learn, has become the cornerstone of establishing a lifelong learning society.
