摘要
作为《民法典》婚姻家庭编的新设制度,离婚冷静期的立法目的在于减少草率离婚,维护婚姻家庭关系的和谐稳定。然而,离婚冷静期制度的适用规则存在不完善之处,相关外部的配套制度规定尚不健全,同时该制度暂不为部分社会公众所接受。对此,可以采取默认适用规则、区分适用规则与调解制度配合适用,并通过普法宣传教育工作提高社会公众的接受度,以期更好地完善离婚冷静期制度自身存在的问题。
As the new system in marriage and family part of Civil Law of China,the legislative purposes of divorce cooling-off period are reducing the number of sloppy divorce and maintaining the stability of marriage and family relations.However,the applicable rules of the system of divorce cooling-off period are imperfect.The external supporting systems are not perfect.And,some members of the public do not accept the new system.Therefore,we can take the default rules,the distinguishing rules,coordination with mediation system and improve the acceptance of the public through publicity of law popularization.It is expected that these suggestions can improve the imperfections of the system of divorce cooling-off period.
