摘要
平台经济逐渐形成了以消费者为中心的市场竞争格局。反垄断法对消费者予以间接保护,无法解释平台经济发展的现状,无法解决平台经济下消费者利益保护的现实问题,因此需要结合平台经济特点对反垄断法进行检视和反思。从现实维度观之,消费者对平台经济的发展具有决定性作用,消费者与平台经济的直接联系加深,且消费者在平台经济下权益更易受损。从规范维度来看,各主要国家反垄断法相关立法日趋重视对消费者的直接保护。鉴于此,平台经济下反垄断法对消费者的定位应从间接保护转换为直接保护。
Platform economy has gradually formed a consumer-centric market competition pattern.The anti-monopoly law provides indirect protection to consumers.It cannot explain the status quo of the platform economy,and cannot solve the real problems of consumer protection in the platform economy.Therefore,it is necessary to review and reflect on the anti-monopoly law in light of the characteristics of the platform economy.From a realistic perspective,consumers play a decisive role in the development of the platform economy.The direct connection between consumers and the platform economy has deepened,and consumers'rights and interests in the platform economy are more vulnerable to damage.From a normative perspective,the relevant legislation of major countries’antitrust laws is increasingly paying attention to the direct protection of consumers.In view of this,the positioning of consumers under the anti-monopoly law under the platform economy should be converted from indirect protection to direct protection.
