摘要
《反不正当竞争法》面临着全新省视消费者利益的理论和时代背景,对消费者利益的保护应当回应数字经济时代竞争的全新特征。该法中的消费者利益具有独立性,不应囿于竞争关系理论、竞争秩序的反射利益、其他法律已提供保护等理由而拒绝为其提供直接保护。消费者利益是指理性消费者自主选择的利益,是不受交易信息误导、不被交易行为压制的利益。在修订《反不正当竞争法》的时代背景中,我国可在一般条款中发展压迫型和违法型两种直接保护消费者利益的案例群,通过赋予消费者团体诉权等方式拓展《反不正当竞争法》的生命力。
Business competition embodies new characteristic in the digital internet era,to which the protection of consumer interests under the Chinese Anti-Unfair Competition Law(AUCL)should be accord.The consumer interests under AUCL are of independent status.The reasons for rejecting direct protection for consumer interests,such as competition relation,reflective interests of competition order or sufficient protection by other laws,can't stand.The consumer interests under AUCL refer to the free choice interests by a reasonable consumer,the one not to be misled or constrained.The groups of cases on aggressive practices and breach of law can be developed in the judicial practice.The vitality of AUCL can be expanded by granting consumer groups the right to sue.
