On the Ideological Origin of“Jurisprudential Taiwan Independence”

摘要 “法理台独”的思想渊源是“台独”思想体系中,能够为体现“台独”的“法制度安排”和“法实践状态”提供直接支持的理论学说的总和。“法理台独”的思想渊源,经过酝酿探索、“理论本土化”和系统完善三个阶段,逐渐形成一套较为完备的理论体系。根据理论学说的功能差异,“法理台独”的思想渊源可划分为实体性“法理台独”思想和程序性“法理台独”思想。实体性“法理台独”思想主要着力于“国家建构”的“主权”“地域”“主体”要素,发展出“民主独立论”“台湾地位未定论”“民族独立论”等学说。程序性“法理台独”思想主要着力于实现实体性“法理台独”思想的具体程序,发展出“宪制独立论”“住民自决论”“托管独立论”等学说。应深刻认识、高度警惕以价值性话语为主轴的“法理台独”的思想渊源对国家统一事业的负面影响,积极对其理论谬误作出精准批判。 The ideological origin of“jurisprudential Taiwan independence”is the sum of theories in the ideological system of“Taiwan independence”,which can provide direct support for“the legal arrangement”and“the legal practice”of“Taiwan independence”.The ideological origin of“jurisprudential Taiwan independence”has gradually formed a relatively mature theoretical system through three stages of brewing and exploration,“theoretical localization”and systematic improvement.According to the functional differences of theories,the ideological origin of“jurisprudential Taiwan independence”can be divided into substantive“jurisprudential Taiwan independence”thought and procedural“jurisprudential Taiwan independence”thought.The substantive“jurisprudential Taiwan independence”thought mainly focuses on the“sovereignty”,“region”and“subject”elements of“national construction”,and develops theories such as“democratic independence”,“undetermined Taiwan Status”and“national independence”.The procedural“jurisprudential Taiwan independence”thought mainly focuses on the specific procedure of realizing the substantive“jurisprudential Taiwan independence”thought,and develops theories such as“constitutional independence theory”,“resident self-determination theory”and“trusteeship independence theory”.We should deeply understand and be highly vigilant about the negative influence of the ideological origin of“Jurisprudential Taiwan independence”with value discourse as the main axis on the cause of national reunification,and actively make accurate criticism of its theoretical fallacies.
