农村集体经营性建设用地治理机制及效应研究--基于上海典型案例土地供应方式的比较被引量：6

摘要本文探索构建了农村集体经营性建设用地供应方式的治理机制及效应对比分析框架,选取上海典型案例进行了实证对比分析。研究结果表明:(1)农村集体经济组织的基础经济实力是影响供应方式选择和治理机制的主要因素;搭建市场交易平台、规范交易价格机制是提高市场化配置效率的基础。农村集体经济组织自治能力、政府政策程序规范程度、收益分配和保障机制、农村集体经济组织经营管理能力是影响乡村可持续发展的关键治理因素。(2)农村集体经营性建设用地不同供应方式都有其独特的特点和适用价值,也存在不同程度的制度缺陷和政策风险。建议从提高农村集体经济组织自治能力和资产经营管理能力、建立企业风险管理基金制度等保障制度、建立集体经营性建设用地基金制度、完善集体建设用地管理制度体系等方面完善治理机制,降低政策风险。 This study explored and constructed the governance mechanism and effect comparative analysis framework of rural collective construction land supply using typical cases in Shanghai for an empirical comparative analysis.The results show that:(1)the basic economic strength of rural collective economic organizations is the main factor affecting the choice of supply mode and governance mechanism,while building a market trading platform and standardizing the trading price mechanism are the basis for improving the efficiency of market-oriented allocation.Moreover,the autonomy of rural collective economic organizations,the degree of standardization of government policies and procedures,income distribution and guarantee mechanisms,and the operation and management ability of rural collective economic organizations are the key governance factors affecting rural sustainable development.(2)Different rural collective construction land supply methods have unique characteristics and applicable values,but each has varying degrees of institutional defects and certain policy risks.Therefore,the governance mechanism should be enhanced and policy risks should be reduced by improving the autonomy and asset management ability of rural collective economic organizations,establishing enterprise risk management fund systems,establishing collective operational construction land fund systems,and improving collective construction land management systems.
