摘要
业主自治是城市小区业主的一项法定权利,也是我国基层社会治理现代化的重要基石。主体平等地位的法律假设、业主大会“高参与”“高通过”的制度设计以及业主组织的“利他主义”设定表明当前城市小区自治立法以形式正义为立法价值导向。以形式正义为价值导向的城市小区业主自治立法强化了业主的“弱者”地位,业主自治权利在实践中遭受“国家和市场的双重挤压”,业主自治权益实现困难重重。推动业主自治法律规制从形式正义走向实质正义,需要以党建引领聚合业主自治资源力量,在承认差异基础上倾斜性配置业主权利,完善业主自治运行机制并进一步强化政府作为义务。
Owners’ autonomy is a legal right of urban community owners,and also an important cornerstone of the modernization of grass-roots social governance in China.The legal assumption of equal status of the subject,the system design of "high participation" and "high passage" of the owners’ meeting and the setting of "altruism" of the owners’ organization show that the current legislation of urban community autonomy is oriented by the legislative value of formal justice.The legislation of owners’ autonomy in urban communities,which is oriented by the value of formal justice,has strengthened the "weak" status of owners,and the right of owners’ autonomy has suffered from the "double squeeze of the state and the market" in practice,and the realization of the right of owners’ autonomy has faced many difficulties.To promote the legal regulation of owner autonomy from formal justice to substantive justice,it is necessary to gather the resources of owner autonomy under the guidance of the party construction,allocate owner rights slanting on the basis of acknowledging differences,perfect the operating mechanism of owner autonomy and further strengthen the obligation of the government.
