摘要
党内法规实施本身是一项制度从制定到落地实施再到效果保障的循环运转的动态过程,引入过程论的观点,在党内法规实施的过程中探索提升党内法规执行力的路径是有效的方式选择。过程论的核心在于运用整体性、系统的思维,不再割裂、片面地研究党内法规运行的某一个方面或某一个阶段,将实施过程的各要素——执行主体、执行行为、执行责任等与实施过程的各阶段——知规、执规、督规综合考虑,观察其作用与影响、互动与耦合的过程。知规是执规的前提,执规是党内法规“落地”的过程,督规是保障党内法规在党的建设工作中“生根”的过程。探索提升党内法规执行力的路径,应当把握以上三个环节内在的运作机理及构造重点,通过观察实施过程中主体、行为及其意识形态等要素探究执行乏力的原因,进行知规过程的权威构造、执规过程的裁量构造以及督规过程的责任构造,在实施的动态过程中探寻提升党内法规执行力的路径。
The implementation of inner-party laws and regulations itself is a dynamic process of cyclic operation of the system from formulation to implementation to effect guarantee.It is an effective way to introduce the viewpoint of process theory,and to explore ways to improve the execution of inner-party laws and regulations in the process of implementing them.The core of the process theory lies in the use of holistic and systematic thinking,no longer to separate and one-sidedly study a certain aspect or a certain stage of the operation of inner-party laws and regulations,but to integrate the various elements of the implementation process:Execution subject,execution behavior,execution responsibility,etc.It comprehensively considers the various stages of the implementation process:Knowing the rules,implementing the rules,supervising the rules.It also observes the process of its role and influence,interaction and coupling.Knowing the rules is the prerequisite for implementing the rules.Implementing the rules is the process of"landing"the inner-party laws and regulations.Supervising the rules is the process of ensuring that the inner-party laws and regulations"take root"in the party’s construction work.To explore the way of improving the enforcement of inner-party laws and regulations,we should grasp the internal operation mechanism and structural focus of the above three links,and explore the reasons for the lack of enforcement by observing the main body,behavior,and ideology in the implementation process,and carry out the authority of the process of knowing the rules.In addition,we should also consider the discretionary structure of the implementation process and the responsibility structure of the supervision process,to explore ways of improving the implementation of inner-party laws and regulations in the dynamic process of implementation.
