摘要
                
                    从道德层面对教师惩戒行为进行审视时,道德往往与人性、合法性、理性以及教育性等混合甚至替换,导致了对教师惩戒行为的弹性界定和随意界定。因此,有必要对其相互关系做学理上的梳理,恢复教育惩戒行为的应然样态:出于师德爱护性的惩戒动机,指向儿童道德发展的惩戒目的;在理性的道德范畴内开展惩戒,基于师德和法律进行惩戒评判。
                
                When the teachers’punishment acts are examined from the moral level,morality is often mixed or even replaced with human nature,legality,rationality and educational nature,which leads to the flexible and arbitrary definition of the teachers’punishment acts.Thus,it is necessary to make a theoretical analysis of the relationship between them,and to restore the act of educational punishment as it should be,including carrying out punishment from the perspective of teachers’love and care for children’s moral development and rationally making disciplinary judgment based on educator ethics and law.
