摘要
人权理论研究范式涉及研究的理论假定、分析框架、论证方式和核心问题。西方人权理论研究存在不同范式的竞争和转换,先后经历神学范式与人学范式、客体性范式与主体性范式、主客体范式与主体间范式、基础范式与建构范式的竞争与转换。人权理论研究范式转换的动力来自于理论面临的现实解释困境和不同范式之间的竞争。人权理论研究范式的转换不仅意味着理论研究的重大变革,而且意味着理论解释力和预测力的提升。
The human rights theoretical research paradigms involve theoretical hypothesis,analytical framework,argumentation methods and core issues.There are competing and transforming paradigms in the study of Western human rights theories,including objective paradigm and subjective paradigm,subjective-objective paradigm and intersubjective paradigm,fundamentalist paradigm and constructivist paradigm.The motivation for the transformation of human rights theoretical research paradigms,comes from the explanatory dilemma faced by the theories and the competition between different paradigms.The transformation of human rights theoretical research paradigms means not only a significant change in theoretical research,but also an improvement in the theoretical explanatory power and the predictive power.
