摘要
美国目前已实现对校园欺凌的法治化治理。官方机构通过统合理论研究中个人独立、隐私权保护等不同立场,合理限定校园欺凌的内涵与外延。在治理层面,美国由联邦到各州全面细化反欺凌立法的多层体系;以恢复性司法为指导,注重民事、刑事司法手段在欺凌冲突治理中的差异化应用;以学校为中心,打破“零容忍”政策壁垒,探索确立积极开放的欺凌干预策略和多元互补的欺凌治理模式。与美国相比,我国亟需改革现行法律体制,确立多层次立法模式,激活校园欺凌治理中的司法功能,完善行政机关的协同联动机制,探索建立符合青少年健康成长规律,旨在恢复青少年社区关系的多元欺凌干预机制。
The United States has achieved the rule of law on school bullying. The official institutions rationally limit the connotation and extension of bullying in the school through different standpoints such as individual independence and privacy protection in the integration theory research.At the governance level,the United States has comprehensively refined the antibullying multi-layered system from the federal to the states;guided by restorative justice,focusing on the differential application of civil and criminal justice methods in the management of bullying conflicts;taking the school as the center,breaking "Zero tolerance" policy barriers,exploring the establishment of active and open bullying intervention strategies and multiple and complementary bullying governance models. Compared with the United States,China urgently needs to reform the current legal system,establish a multi-layered legislative model,activate the judicial function in the management of bullying,improve the coordination mechanism of administrative agencies,and explore the establishment of a pluralistic model that is in line with the healthy growth of adolescents and restores adolescent community relations bullying intervention mechanism.
