学前教育立法中的家长教育权条款研究 被引量:1

A Research on Parents’ Right to Education in the Legislation of Preschool Education

摘要 家长教育权具有复合性,它既是父母或监护人基于监护权对儿童所享有的天然权利,又是儿童基于受教育权所派生的法定权利,所以家长教育权需恪守伦理边界与利益边界.鉴于学龄前儿童受教育权以自由权为主的权利属性和以游戏为主的权利实现方式,学前教育阶段的家长教育权具有基础性与优先性,内容主要包括全面教育权、选择教育权与参与教育权.建议在学前教育立法中预留出家长教育权的表达空间:基于权利的复合属性明确家长教育权的基础与优先地位,基于权利内容细化家长教育权的权利类型,基于权利边界厘清家长在学前教育阶段所应承担的教育义务及法律责任. Parents’right to education is compound. It is not only the natural rights of parents or guardians to children based on guardianship rights, but also the legal rights of children based on the right to education. Therefore, parents’right to education must abide by ethical boundaries and interest boundaries. In view of the rights of preschool children to receive education are based on the right to freedom and the right to play,parents’right to education in preschool education stage are basic and priority. The content mainly includes the right to comprehensive education, the right to choose education and the right to participate in education. It is suggested that the space for expressing parents’right to education should be set aside in preschool education legislation:based on the compound attributes of right to clarify the basis and priority of parents’ right to education, based on the content of right to refine the type of parents’ right to education, and based on the boundary of right to clarify the educational obligations and legal responsibilities of parents in the preschool education stage.
