摘要
民事公益诉讼是法定主体针对侵害公共利益之民事违法行为,诉诸法院以追究违法责任并借此捍卫公益的法律制度。在当前互联网侵害现象频发、侵害范围日益扩大、互联网公益亟待救济的背景下,互联网民事公益诉讼成为理论学界和司法实务界的新兴探索路径。但囿于法律规范缺位、司法理念滞后、互联网公共利益定性不清等因素,司法实践中存在案件数量少、受案范围不明晰、规范理解有差异、审理程序不明确等问题,以致互联网公益诉讼制度设计的司法功能发挥严重受限。对此,应当进一步明确互联网民事"公益"的认定标准,论证互联网民事公益诉讼的必要性所在,构建互联网民事公益诉讼范围体系,进而完善互联网民事公益诉讼的程序设计流程,为司法实践提供参考借鉴。
Civil public interest litigation is a legal system in which statu-tory subjects take civil violations of public interest and resort to courts to inves-tigate the liability for violations and defend public interest.Against the back-ground of the frequent occurrence of Internet infringements,the increasingscope of infringements,and the urgent need for relief for Internet public wel-fare,Internet civil public interest litigation has become an emerging path of ex-ploration in the theoretical and academic circles and judicial practice circles.However,due to factors such as the absence of legal norms,lagging ju-dicial concepts,and unclear definition of Internet public interests,there areproblems in judicial practice such as the small number of cases,the unclearscope of cases,the difference in normative understanding,and the unclear tri-al procedures,which have led to Internet public welfare The judicial functionof the litigation system design is severely restricted.In this regard,it is neces-sary to further clarify the identification standards of Internet civil"public inter-est",demonstrate the necessity of Internet civil public interest litigation,buildthe scope of Internet civil public interest litigation system,and improve theprocedure design process of Internet civil public interest litigation,and providereference for judicial practice.
