摘要
教育法律的生命在于通过司法适用解决现实存在的教育纠纷。通过分析援引教育法律的808起诉讼案件可以发现,教育法律虽有一定程度的司法适用,但其适用状况仍难尽人意。当前仅3&80%的教育法律条款被司法适用,且其适用主要发生在民事领域,这弱化了教育法律对教育行政生活的调节作用,也使其成为司法适用频率最低的部门法。此外,法院对教育法律的适用显著超过当事人对教育法律的援引,且法院的适用更多是用来说理而非裁判。为使教育法律真正从“法律文本”走向“教育生活”.需进一步提升教育主体诉讼观念、扩大教育案件受案范围、改进教育立法质量、加大教育法律的普法力度。
The life of education law lies in resolving the existing education disputes through judicial application.Through the analysis of 808 lawsuits invoking the education law,it is found that although the education law has a certain degree of judicial application,its application status is still unsatisfactory.At present,only 38.80% of education legal provi sions have been used by the judiciary,and their application mainly takes place in the civil field,which weakens the regulatory effect of the education law on education life,and makes it the department law with the lowest frequency of judicial application.In addition,the court's application of education law significantly exceeds the parties' invocation,and the court's application is more for reasoning than for adjudication.In order to move the education law from "legal text"to "education life",it is necessary to further enhance the concept of litigation,expand the scope of educational cases,improve the quality of educational legis lation and strengthen the popularization of education law.
