摘要
虚拟人物形象是构成小说的重要创作元素,不属于真实人物形象的范畴,包括虚拟人物的形象、名称、造型等,它往往属于具有独创性的表达,通常与原小说视为一个整体,共同受著作权法保护。但小说中的虚拟人物形象能否独立于原小说、单独受著作权法保护,颇具争议。对于符合作品构成要件、在脱离原小说后仍能被读者所识别并存在于读者认知中的虚拟人物形象,显然能够作为"作品"单独受著作权法保护。满足特定条件的虚拟人物形象尽管能单独受著作权法保护,但《著作权法》却难以规制单纯使用小说中虚拟人物形象名称的行为,就此类行为而言,权利人可以通过援引《反不正当竞争法》对虚拟人物形象的名称进行保护。
There is an increasing number of related copyright disputes arising from the use of virtual character images in fictions.The virtual character image constitutes an important creative element of the novel and does not belong to the category of real character,including the image,name,and shape of the virtual character.It is often regarded as an expression of originality and usually considered as a whole with the original novel,which is jointly protected by the Law of Copyright.However,it is controversial whether the fictional virtual character image can be independent of the original novel and protected by the Law of Copyright alone.For the virtual character images which meet the compositional elements of the work and can still be recognized by the readers and exist in the their cognition after being separated from the original novel can obviously be protected as a“work”independently by the Copyright Law.Although the virtual character images satisfying certain conditions can be protected by copyright law alone,it is difficult for the Copyright Law to govern the behavior of simply using the name of a virtual character in a novel.In terms of such kind of behavior,the right holder can protect the name of the virtual character image by citing the Anti-unfair Competition Law.
