摘要
在著作权问题研究中,文学作品是颇受关注的一个领域。在文学作品著作权研究上,由作者塑造的文学角色问题尤为特殊。然而无论在立法上还是司法实践过程中,文学角色由著作权保护,还是反不正当竞争法保护,亦或其他方式获得救济均存在较大争议,笔者想从文学角色的著作权问题研究上加以讨论,更好地厘清这个问题,从而得出文学角色应受著作权法保护的结论。
In the study of copyright,literary works are an area of great concern.In the study of literary works copyright,the literary role created by the author is particularly special.However,no matter in the process of legislation or judicial practice,there is a big controversy over whether the literary role is protected by copyright or protected by improper competition law anyway,or compensated by other means.I want to discuss this issue from the perspective of the research on the copyright of literary role,so as to better clarify this issue.
