摘要
目前学术界在研究中国法律职业共同体行为规范的过程中,伦理规范研究较少,为此从伦理规范的视角来认识行为规范具有创新意义。合理界定中国法律职业共同体伦理规范的概念后,可以发现行为与伦理关系密切,研究行为规范离不开伦理规范。行为规范与伦理规范在规范内容、规范稳定性、规范作用等方面存在差异,可以从原则、规则与价值等方面阐释中国法律职业共同体伦理规范的具体内容。法官、检察官和律师等不同主体的伦理规范有所不同,将法学学者纳入中国法律职业共同体伦理规范的体系中并对其进行规范还需要进一步研究,但法官、检察官、律师和法学学者应该朝着共同伦理规范的方向迈进,这样方能助益法律职业共同体的形成。
The academic circles do not attach much importance at present to the study of ethical norms in the process of studying the behavioral norms of Chinese legal professional community.Therefore,it is innovative to recognize behavioral norms from the perspective ol ethical norms.Based on the rational definition ol the concept ol Chinese law prolessional community ethics,we believe that behavioral norms and ethical norms are closely related,and behavioral norms can not be separated lrom ethical norms.There are differences between behavioral norms and ethical norms in norm contents,norm stability and norm lunctions.We can explain the specilic contents ol ethical norms of Chinese legal prolessional community lrom principles,rules and values.Followed by judges,prosecutors and lawyers,we analyze in detail their dillerent ethical norms,and linally point out that to put legal scholars into ethics system ol Chinese legal prolessional community needs lurther study,but that judges,prosecutors,lawyers and legal scholars can lorm a good prolessional community as long as they move toward the direction of a common ethic.
