摘要
守法的精神是公民基于对法律的价值合法化的认同而自发形成的守法动力,是出自内心地视遵守法律为道德自觉的主观理念。在现代社会,公民的守法精神主要表现为三个方面,一是规则意识,它又体现为三个层面:规则至上、注重程序和对权力进行制衡。二是正义感,包括权利意识和相互性两个方面。三是公共理性,它是守法精神的一个核心要素。
Law-abiding spirit is the drive to abide by the law developed in the citizen after his recognition of the legitimacy of the law.It is a subjective idea that regards law abiding as a moral consciousness.In modern society this spirit consists of three aspects: 1.awareness of rules,which includes the supremacy of rules,an emphasis on the procedure and balance of power;2.sense of justice,which includes the awareness of rights and the nature of mutual exclusion and;3.public reason,which is the a core element in the spirit of law abiding.
