摘要
在依法治国的背景下,律师作为法律群体重要角色之一,对推进法治国家和法治社会建设进程起着重要作用,律师职业伦理建设自然而然成为其中重要一环。在不同意义上对律师职业伦理做出阐释,律师职业伦理的内涵分为“底线伦理”和“更高道德义务”两个层面。整体上看,律师职业伦理弱化原因有二:一是律师行业缺乏良好的竞争秩序;二是整个律师队伍缺乏有效监管。良好行业竞争秩序的构建,需要通过法律制度的完善来实现,而对于律师整体队伍缺乏监管的现状,则需要通过建立不良行为披露机制来提升整体监管水平。
In the context of the rule of law, lawyers, as one of the important roles of legal groups, play an important role in promoting the construction of a country ruled by law and a law-based society, and the construction of lawyer professional ethics has naturally become an important part of it. The professional ethics of lawyers can be explained in different meanings. The connotation of lawyer professional ethics is divided into two levels: “bottom line ethics” and “higher moral obligation”. On the whole, there are two reasons for the weakening of the professional ethics of lawyers: the lack of a good competition order in the legal profession, and the lack of effective supervision of the whole lawyer team. For the construction of a good industry competition order, it is necessary to improve the legal system, and for the lack of supervision of the overall team of lawyers, it is necessary to establish a bad behavior disclosure mechanism to improve the overall supervision level.
