摘要
为顺应农村社会发展需要,推动新型工业化、信息化、城镇化和农业现代化,中央明确提出改变联产承包责任制中土地由集体拥有所有权和农户拥有承包经营权的"两权分离"模式为集体有所有权、农户有承包权和经营者有经营权的"三权分置"模式,以期解决农民融资难问题、促进农业适度规模经营、提高土地利用效率。在梳理"三权分置"的概念、必要性、意义以及"三权"的内涵后,文章重点探讨了"三权分置""是否符合现行法律规定""是否是农村社会的自然需求"和"是否等同于永佃制的权利安排"等三个学界争论焦点,并提出土地问题的跨学科性决定了"三权分置"研究需要处理好改革与现行法律、理论与具体实践、共性与个性等三个根本性关系。
With the central government clearly puts forward ＂Division of Three Rights＂ of farmland, more and more people have been paying attention to and studying this highly innovative system reform. By sorting out emergence and development of the research on ＂Division of Three Rights＂, this thesis summarizes the concept, connotation, necessity and significance of ＂Division of Three Rights＂, and discusses the three power points of the theoretical argument. At last, we give a brief re- view and prospect of the present research on this characteristic problem.
