摘要
长期以来,个人医疗信息的法律保护存在信息不对称问题。由于个人医疗信息不对称而引起的医疗纠纷越来越多,一定程度上影响了我国医疗卫生事业的健康发展。文章通过发放调查问卷,调查患者对个人医疗信息法律保护的了解状况及对我国个人医疗信息法律保护现状的认识,从信息不对称视角探讨影响个人医疗信息法律保护的信息知晓情况的相关因素,分析个人医疗信息法律保护方面遇到问题产生的原因,进而从个人应主动了解个人医疗信息的法律保护方面的相关信息、医院要制定完善的个人医疗信息的法律保护机制、政府和其他相关社会机构应通力合作等方面提出了相应策略。
For a long time,the legal protection of personal medical information exist the problem of asymmetric information. Patients＇ personal medical information leakage caused by more and more medical disputes and it hinders the healthy development of China＇smedical and health undertakings. In this paper, through questionnaires, to understand the status of legal protection of per- sonal health information survey patients and understanding of China＇s current situation of legal protection of personal health informa- tion. To explore the factors related to personal health information of the legal protection of information awareness from the perspec- tive of information asymmetry. Analysis of legal protection of personal medical information cause of problems encountered, and then from the individual should take the initiative to understand the personal medical information of the legal protection of related infor- mation, the hospital should establish perfect personal medical information legal protection system, government and other social insti- tutions should act with united strength etc. to put forward corresponding strategies.
