摘要
杨立新教授是我国最早开始研究侵权法的学者之一,也是中国当代侵权法最为重要的代表性人物之一,为中国侵权法理论体系的建立和《侵权责任法》的起草立下了汗马功劳。杨立新教授的侵权法思想不但具有本土性和实用性,更为重要的是实现了侵权法体系化展开和类型化研究的结合。杨立新教授的侵权法思想主要分为侵权责任构成论、侵权行为类型论、侵权责任形态论和侵权损害赔偿论四个方面。在民法典中侵权法独立成编思想指引下,杨立新教授的侵权法思想具有一定的立法主导性。《侵权责任法》最终吸收了大量杨立新教授的研究成果和立法建议稿内容。
Prof. Yang Lixin is one of the first group of scholars to begin the research on tort law in P. R. China, and he is also one of the most important representative persons in modern Chinese tort law. He has made great contribution to the construction of Chinese tort law system and the legislation of Tort Liability Law. Prof. Yang Lixin＇ s thoughts on tort law are not only with local and practical characteristics, but also realize the combination of systematically ramification and typological research in tort law system. Prof. Yang Lixin＇ s thoughts on tort law consists of four parts, namely, the theory of composition of tort liability, the theory of typology of tortious acts, the theory of modalities of tort liability and the theory of compensation for tort damage. Guided by the thought of drafting independent division of tort law in Civil Code, Prof. Yang Lixin＇ s thoughts on tort law are with characteristics of legislative domination to some extent. Tort Liability Law absorbs many Prof. Yang Lixin＇ s research findings and contents in his propositional draft of tort liability law.
