摘要
                
                    对特定的人格要素可以进行商业利用并能带来经济利益,究其本质是人格要素及其蕴涵的影响力所产生,此种利益应属于主体自身享有。基于人格和人格权的非财产属性,此种附着于人格要素的经济利益应当纳入财产权的保护范围,此谓人格信息财产权。此种权利与人格权一起为人格要素提供了并行不悖的双重保护。
                
                Specified personality elements can exploited commercially and can bring economic benefits,the basic reason for this is the influence implied by the name and its personality.The benefits should belong to the subject.Personality and right of personality are not properties,the economic benefit attached to personality and personality rights should be classified into catalogue of the protection of property rights,it is property right of personality information.This right,combined with the personality right,provides parallel protection for personality elements.
