摘要
树立司法权威对于法治国家具有重要意义,司法权威不仅需要司法独立的外部制度保障,而且需要司法谦抑作为内在的道德支撑。司法谦抑的品性源于司法机关的特殊地位、司法权的行使方式和法官的职业特点。司法谦抑能够弥补司法权民主性的不足,增强司法裁判的说服力,消减公众对司法骄横的疑虑,从而为树立司法权威提供道德基础。
Judicial authority plays an important role in rule of law. Judicial authority not only need the sustaining of judicial independence system,but also the guarantee of judicial humility. Judicial humility is due to special status of justice department, the manner of exertion of judicial power and the characteristic of judge profession. Judicial humility can make up the deficiency of democracy of judicial department, strengthen the persuasion of decislon,reduce the public fear of judicial peremptoriness.Therefore, judicial humility is the moral basis of judicial authority.
