摘要
人权与宪法相伴相随、密不可分。宪法作为人权保障书 ,既是对已有人权的确认 ,也是人权发展的保障。从宪法产生和发展的历史轨迹来看 ,无论是资产阶级宪法还是社会主义宪法 ,都是以确认和保障基本人权为中心而展开的 ,近现代人权事业的发展都会在宪法中得到体现和反映 ,而宪法的进步又推动着人权事业的发展。现代宪法主要通过确认人权原则和人权范围、规定国家权力的运行规则和确立违宪审查制度来实现对人权的保障功能。
Human rights and constitution goes together and links together.As the safeguarding book of human rights,constitution is both the confirmation of existing human rights and the guarantee of the development of human rights.From the standpoint of historical course of constitution's origin- ation and development,both capitalist and socialist constitution develops around the center of conf- irming and guaranteeing of basic human rights,and all developments of modern human rights were embodide and reflected in constitutions.In turn,the progress of constitution promoted the develop- ment of human rights cause.Modern constitutions' human rights protection function is realized thr- ough confirmation of human rights' principles and scope,stipulating the moving regulations of state power,and establishing the unconstitutional review system.
