摘要
在承认共谋共同正犯概念的基础上确立相应的脱离制度,不仅是对我国司法实践中出现的从共谋共同正犯关系中脱离的行为人进行正确定罪量刑的重要举措,更是弥补我国现有犯罪停止形态理论在解决退出共犯关系问题上的不足的必要手段。同时,这一制度的确立也有利于完善我国共同犯罪理论,进一步限制共犯制度的处罚范围。不同类型的共谋共同正犯脱离的成立需要具备不同的条件。"追随型"、"平等型"以及"首谋型"共谋共同正犯脱离的成立条件之间存在层层递进的关系。
Based on the recognition of the concept of collusive co- principal,the establishment of the corresponding system of withdrawal is not only the important measure of proper conviction and sentencing for those who retreat from the relationship of collusive co- principal in judicial practice,but also the necessary means for overcoming the shortcomings presenting in solving the problem of withdrawing from the accomplice offense relationship by use of the current theory of stop patterns of crime. At the same time,the establishment of this system is also conducive to the perfection of the theory of joint crime,and further limits the scope of punishment system of accomplice offense. As far as the different withdrawals from the relationship of collusive co-principals is concerned,different conditions are needed. Among the conditions of establishment of the withdrawals from the relationship of collusive co- principals of following type,equality one and that of principal plotter,there exists progressive relationship.
