摘要
“道德法律化”是指两种极端的倾向 :一是完全排斥道德因素 ,过分强调法律的形式特征或工具性的极端倾向 ;二是企图以法律拯救道德 ,把法律作为推行某种“道德”的工具。过份强调法律的工具性或形式特征 ,排斥甚至完全否定法律带有普遍性的价值因素 ,法律就可能变成一具没有灵魂的躯壳或威胁人类的怪物。如果仅仅把法律当作张扬道德的工具 ,就会导致道德与法律对人类良心的双重奴役。
Moral legalifation' refers to two extremes in this thesis:First,it is the moral factors that have been excluded from legalifation;Second,law has been practised to save morality from its own invalidity.When the instrumentalistic or formalistic features of law are to be over emphasized,some prevalent value is denied absolutely, law itself will be probably turned into a skeleton without soul or an endangering monster; meanwhile,if law is only to be used as an instrument of advocating morality,such unhappy ending as double enslavement of morality and law upon human conscience will be likely to occur.
