摘要
传统的法律他律性以法律的外在强制性作为立论基础,过分强调国家强制力在法律实施中作用的同时忽视了自律对法律的作用不利于公众自觉守法意识的培育。随着中国法治建设的不断推进,一方面传统法律他律论的基础已经发生改变,另一方面自律性在法治建设中的作用不断显现。自律性是法律得以实施的重要基础,他律性只是一种外在的保障,因此在法治现代化过程中给予法律自律性必要的关注和客观的认识不仅有助于准确定位现代法律的价值取向,而且是最终实现良法善治的内在要求。
The traditional legal heteronomy is based on the external compulsory of law,overemphasizing the role of state coercion in the implementation of law while neglecting the autonomy of law,which is not conducive to the cultivation of public awareness of law-abiding.With the continuous advancement of the rule of law in China,on the one hand,the foundation of traditional legal heteronomy has changed,and on the other hand,the autonomy of law in the construction of the rule of law has emerged.The autonomy of law is an important basis for the implementation of law,while heteronomy is only an external guarantee.Therefore,the necessary attention and objective understanding of legal self-discipline in the process of modernizing the rule of law not only helps to accurately locate the value orientation of modern law.Moreover,it is the inherent requirement for the ultimate realization of rule of law and sound governance.
