摘要
随着中国开放发展格局达到了一定的层次与规模,为了切实、精准地维护我国主权、安全、发展利益,坚持统筹推进国内法治与涉外法治已然跃升为建设法治中国的应有之义。目前,中国既处于全球环境治理赤字危机的时代背景下,又深陷西方国家对我国海外投资建设施加绿色规锁的困局。因此,涉外环境法治便成为构建涉外法治话语体系中的关键议题。一方面,涉外环境法治的生成源于国内环境法治与国际环境法治深度衔接的助力,并在国内环境法治与国际环境法治的互动中发挥着转译功能;另一方面,涉外环境法治又试图施展独立的统筹价值,在审视国内环境法治运行的基础上,洞察国际环境法治的发展全貌。在这种互动向互构的发展趋势下,中国亟待完善涉外环境法治体系,从理念意蕴、系统规范、运行机制与特色平台出发,达成涉外环境法治在实体规范与形式效能之间的动态平衡,力求在国际环境法治体系中镌刻中国印记。
As China's opening-up pattern has reached a certain level and scale,in order to effectively and accurately safeguard national sovereignty,security and interests,adhering to coordinate domestic rule of law and foreign-related rule of law has jumped to the meaning of China's rule of law.China is not only in the context of the global environmental governance deficit crisis,but also deeply trapped in the dilemma of Western countries imposing green confinement on China's overseas investment.Hence,the foreign-related environmental rule of law has become a key issue in the construction of the foreign-related rule of law discourse system.On the one hand,foreign-related environmental rule of law stems from the help of the deep connection between domestic environmental rule of law and international environmental rule of law,and plays a translated function between domestic environmental rule of law and international environmental rule of law.On the other hand,foreign-related environmental rule of law attempts to display the independent value.On the basis of examining the operation of domestic environmental rule of law,it has an insight into the overall development of international environmental rule of law.In the process of development from collaborative interaction to innovative construction,China requires to explore the conceptual meaning,system norms,operating mechanism and characteristic platform of foreign-related environmental rule of law,achieve a dynamic balance between substantive rules and formal efficiency of foreign-related environmental rule of law,and strive to engrave China's mark in the international environmental rule of law.
