摘要
当前人大对重大行政决策的监督比较薄弱,其监督地位趋于边缘、监督措施缺乏约束、监督程序存在漏洞。造成人大监督薄弱的根本原因是重大行政决策制度秉持行政自制理念,相应的监督更强调行政系统的内部监督,自由裁量免受外部审查,以及决策事后的结果归责。然而,对重大行政决策的人大监督有强化的必要性和可能性,一方面,人大与政府在重大事项上的权力相互交织,行政裁量权力需要受到更强有力的控制;另一方面,人大监督、特别是人大常委会的监督具有一定的优势条件。强化人大监督,需要在尊重行政权力的前提下行使监督权,突出监督权在人大权力中的独立地位,具体地要从重置决策事项确定权的归属等多个方面优化制度安排。
The supervision exercised by people’s congresses over major administrative decisions is still weak,as its supervisory status tends to be marginal,its supervisory measures lack restraint and there are loopholes in supervision procedures.The fundamental reasons for this weakness is the firm conception of administrative self-discipline in the system for major administrative decision,which emphasizes more on internal supervision,the administrative discretion free from external review,and the result-oriented attribution of responsibility in administrative decisions.However,it is necessary and possible to strengthen the supervision by people’s congresses over major administrative decisions.On one hand,the authorities of the people’s congresses and the governments over major matters are intertwined,and the administrative discretion needs more powerful control.On the other hand,the supervision by people’s congresses,especially by their standing committees have some advantages.The supervision by people’s congresses should be exercised by respecting the authority of the administrative power and accentuating the independence of this supervisory power;many institutional arrangements should also be made for many respects,including the determination of the powers to make major administrative decisions.
