摘要
网店刷单是由网店与非真实消费者合谋,通过虚拟交易、虚拟好评,以使指定网店在商品搜索中排名靠前、牟取利益的非法行为。网店刷单分为三种模式:返利模式、混杂模式、分级模式,后两种模式是职业性刷单行为,符合传销行为的特性。组织、领导传销活动罪规制"拉人头""收取会费"两种传销行为,该罪规制的不是经营活动而是传销活动。刑法对传销犯罪单轨制的规制模式下,具备传销性质的职业性刷单活动应以组织、领导传销活动罪规制而不能纳入非法经营罪的犯罪圈之中。职业性刷单活动中承担刑罚责任的主体有:职业性刷单活动的领导者、组织者,即网店经营者和部分职业刷单手,电商平台只承担监管失职的行政责任或民事责任,对于最底层的刷单人应施加制度性惩罚措施。
Online shop brush is a collusion between online stores and non real consumers by virtually transacting and praising,so that the designated online stores can get good rankings in the commodity search and illegal profits.Shop brush is divided into three modes:rebate mode,mixed mode and grading mode.The latter two modes are professional brushes behavior,which is consistent with the characteristics of pyramid selling behavior.The crime of organizing and leading the pyramid selling activities regulate two kinds of pyramid selling behavior,"pull the head"and"collect the membership fee".The crime regulates a pyramid selling activity rather than a business activity.Under the single regulation mode of pyramid selling in criminal law,the professional brush activities should be regulated by the crime of organizing and leading pyramid selling activities other than the crime of illegal operation.In professional brush activities,leaders and organizers that the shop operators and some occupation brush undertake the due obligations;business platform only assume regulatory dereliction of duty administrative or civil responsibility;for the bottom of the single brush should be applied system of punishment measures.
