摘要
间接正犯概念是否应当存在,学界存在肯定论与否定论两种观点。否定论的观点并不充分,无法解决取消间接正犯概念后的理论与实践难题。肯定论中的工具说、规范障碍说、国民道德观念说均存在着较大的缺陷,无法满足理论与实践的需要,而意思支配说可以弥补实行行为性说的缺陷。实行行为性说可以为意思支配说提供形式上的限制。因此,在肯定间接正犯存在必要性的前提下,应当采用将支配理论的核心思想引入实行行为性说的新的理论构造,既能弥补实行行为性说内涵不够明确的缺陷,也能避免意思支配说中正犯范围的泛化。
Whether the concept of indirect criminal should exist,there are two viewpoints in academia:positive and negative.The theory of negation is not sufficient and cannot solve the theoretical and practical problems after the concept of indirect criminal is cancelled.The instrumental theory,normative obstacle theory,and national morality theory in the positive theory all have large defects and cannot meet the needs of theory and practice.The dominance of will theory can make up for the shortcomings of the implementation act theory.The implementation act theory can provide formal restrictions for the dominance of will.Therefore,under the premise of affirming the necessity of indirect criminal,a new theoretical structure that introduces the core ideas of the dominance of will theory into the implementation act theory.The new structure can not only make up for the lack of the implementation act theory,but also avoid the generalization of the scope of the indirect criminal in the dominance of will.
