摘要
分析有关安全事故监管渎职犯罪的100份判决书,该类犯罪的量刑存在刑事处罚总体偏轻、适用法定从宽处罚情节时从宽的幅度过大、酌定从轻处罚情节适用不规范、自由裁量权行使标准不统一等问题。改进该类犯罪的量刑工作,要正确贯彻执行对安全事故监管渎职犯罪从严处罚的刑事政策,规范量刑情节的适用,补充监管渎职犯罪的量刑指导内容,建立量刑参照模板,建立监管渎职犯罪专门指导案例库。
The analysis of 100 judgments on crimes of dereliction of supervision duty over safety accidents finds that there are such problems as the overall severity of criminal punishment,the excessive degree of leniency in the application of statutory lenient punishment,the non-standard application of discretionary lighter punishment,and the non-standard exercise of discretionary power.To improve the sentencing of such crimes,it is necessary to correctly implement the criminal policy of imposing stricter penalties for crimes of dereliction of supervision duty over safety accidents,standardize the application of discretionary circumstances,supplement the sentencing guidance for crimes of dereliction of supervision duty,establish a sentencing reference template and set up a database of cases for specific guidance on crimes of dereliction of supervision duty.
