摘要
黑社会性质组织犯罪作为一种典型的有组织犯罪,因其社会危害性较大,历来是理论与实践所共同关注的重点犯罪问题之一。以中国裁判文书网上的裁判文书为样本,对中部地区黑社会性质组织犯罪的具体情况进行实证分析,可以发现该区域与我国其他地区在涉黑犯罪上所具有的共同特征及不同特点。要从根本上整治黑社会性质组织犯罪,既需要在理论上加强犯罪研究,又需要分别从经济、文化教育和社会管理层面施以长效性和针对性的措施与对策。
As a typical organized crime,the gangland-like organizational crime has always been one of the key criminal problems that are concerned by theory and practice because of its great social harmfulness.The specific conditions of gangland-like organizational crime in Central China are analyzed empirically based on online judgements of China.And it is found that as for gangland-like organizational crimes,Central China has not only the same characteristics as other area of China but also some different characteristics from other regions.To prevent and control the gangland-like organizational crimes,it is necessary to strengthen the theoretical study of crime and take effective and targeted measures from the perspective of economy,cultural education,and social management.
