摘要
我国现行宪法是在“五四宪法”基础上制定的。“五四宪法”是新中国第一部正式宪法,也是中国历史上第一部人民宪法、社会主义类型宪法。“五四宪法”在制定基础、制定目的、制定方法方面体现了毛泽东人民立宪思想,需要置于毛泽东人民立宪思想和当代中国宪法制度历史变迁中加以考察。着重分析“五四宪法”所体现的毛泽东人民立宪思想,对于推动我国现行宪法全面实施具有重要的启示意义。
The current Constitution of China was formulated on the basis of the Constitution of 1954.As the first formal constitution,people’s constitution,and socialist constitution of New China,it directly manifestes Mao Ze-dong’s thought of popular constitutionalism.The Constitution of 1954 embodies Mao Ze-dong’s thought of popular constitutionalism in terms of the basis,purpose and method of its formulation.The Constitution needs to be analysed in the context of Mao’s thought of popular constitutionalism.And his thought of popular constitutionalism embodied in the formulation basis,purpose and method is an important inspiration for promoting the full implementation of China’s current constitution.
