摘要
在平安中国建设中,健全社会矛盾纠纷预防化解机制,完善调解、仲裁、行政裁决、行政复议、诉讼等有机衔接、相互协调的多元化纠纷解决机制是重点,而从源头上预防矛盾纠纷、诉讼前解决矛盾纠纷的“诉源治理”是多元化纠纷解决机制的进一步延伸和深入。随着经济社会快速发展、各民族间交流交往交融的增加,矛盾纠纷呈现出多发态势。这些矛盾纠纷因交织着经济利益、民族因素、宗教因素而表现出复杂性。民族地区矛盾纠纷的预防和快速有效化解事关祖国统一、民族团结、社会和谐。因此,在民族地区的诉源治理中,利用一切可利用的资源来预防化解矛盾纠纷有着更加特殊的意义。
In the construction of Ping An China,the key point is to improve the prevention and resolution mechanism of social contradictions and disputes,and to improve the diversified dispute resolution mechanism of mediation,arbitration,administrative adjudication,administrative reconsideration,litigation,etc.The"litigation source governance"of preventing conflicts and disputes from the source and resolving conflicts and disputes before litigation is the further extension and deepening of diversified dispute resolution mechanism.With the rapid development of economy and society and the increase of exchanges and exchanges among different ethnic groups,conflicts and disputes have been in a multi-modal situation.These conflicts and disputes are complicated because of the economic benefits,ethnic factors and religious factors.The prevention and effective resolution of conflicts and disputes in ethnic areas are related to the reunification of the motherland,national unity and social harmony.Therefore,it is of more special significance to use all available resources to prevent and resolve conflicts and disputes in the governance of source of litigation in ethnic areas.
