摘要
涉诉信访源头治理的本质是信访风险的预防,意味着人民法院应当通过多元化的手段,将具有信访风险的矛盾在基层予以实质性化解。涉诉信访的源头治理经历了从无到有,再到与非诉纠纷解决机制、源头治理等融合发展的过程。实践中,人民法院形成了一套以风险评估为先导、以多元共治为支撑、以非诉化解等多元化纠纷解决为核心的涉诉信访源头治理机制。源头治理的开展,造成了调解与裁判的不当竞争,息诉息访逻辑对裁判逻辑的冲突,社会治理功能对依法审判功能的冲击。未来,应当确定宽严适度的诉前调解案件范围,坚持审判中心地位,完善多元共治的源头治理格局。
The essence of the source governance of petitions related to lawsuits is to prevent the risks of petitions,which means that the people's courts should resolve the contradictions with the risks of petitions at the grassroots level through diversified means.The source governance of petitions related to lawsuits has experienced a process of integration and development from nothing to non-litigation-related dispute resolution mechanism and source governance.In practice,the people's courts have formed a set of petitions related to lawsuits source governance mechanism with risk assessment as the guide,diversified co-governance as the support,and diversified dispute resolution such as non-lawsuit resolution as the core.The development of source governance has resulted in the improper competition between mediation and adjudication,the conflict between the logic of interest and appeal and the logic of adjudication,and the impact of the social governance function on the function of adjudication according to law.In the future,we should determine the scope of pre-trial mediation cases with appropriate leniency and severity,adhere to the central position of trial,and improve the source governance pattern of multiple co-governance.
