摘要
公正是法律的永恒追求,而司法是实现法律公正的主要载体。然而如何通过司法运用实现法律公正却是法学理论与司法实践的一个难题。彭中礼教授在《中国社会科学》发表的《论法律学说的司法运用》一文,深刻探讨了如何运用法律学说以实现司法公正的问题,其中不少洞见的确值得警醒与反思。经多次仔细研读,深感其有许多嘉惠学人之处,将彭文拓新面向及商榷之处一并展示,以利法律学说司法运用研究的进一步推进。
Justice is the eternal pursuit of law,and justice is the main carrier to achieve legal justice.However,how to realize legal justice through judicial application is a difficult problem in legal theory and judicial practice.Professor Peng Zhongli’s article"On the Judicial Application of Legal Doctrines"published in"Chinese Social Science"deeply explored the issue of how to use legal doctrines to achieve judicial justice.Many of these insights are indeed worthy of vigilance and reflection.After many times of careful study,I feel that there are many places to be appreciated and appreciated by scholars.I will show pengwen’s new orientation and discussion together,so as to further promote the study of judicial application of legal theories.
