期待可能性理论的本土资源与本土化研究

摘要发源于德国的期待可能性理论,凭借其历史和现实的合理性对日本刑法产生深远影响并取得长足发展。新旧世纪交替之际,中国刑法学经历了一场前所未有的知识转型,伴随着德日刑法理论的引进,期待可能性理论开始进入刑法学界的视野。期待可能性作为“舶来品”,在传统刑法的四要件犯罪论体系中并没有“栖身之所”,相对封闭的体系结构是引进期待可能性的最大障碍,因此不能简单地奉行“拿来主义”。我国刑法想要借由引进期待可能性理论来丰富自身体系,必须还原该理论的本来面目,并注重本土资源的运用,推进期待可能性理论的创造性转化。历史和现实反复证明,只有坚持“古为今用、洋为中用”,推进现代法治文明的创造性转化与传统法律文化的创新性发展,才能走出一条法治现代化的中国道路。 The theory of anticipated possibility,which originated in Germany,has had a profound impact on Japanese criminal law and made great progress by virtue of its historical and realistic rationality.At the turn of the century,Chinese criminal jurisprudence experienced an unprecedented knowledge transformation.With the introduction of German and Japanese criminal law theories,anticipated possibility began to enter the field of Chinese criminal law.As“imported goods,”anticipated possibility does not have a“shelter”in the four-requirement crime theory system of traditional criminal law.Since the relatively closed system structure is the biggest obstacle to introducing anticipated possibility,simply pursuing the doctrine of“taking”is not practical.If our criminal law wants to enrich its system by introducing anticipated possibility,we must restore the original features of the theory,pay attention to the application of indigenous resources,and promote the creative transformation of anticipated possibility.History and reality have repeatedly proved that only by adhering to the principle of“drawing from past and foreign achievements”and promoting the creative transformation of modern civilization of the rule of law and the innovative development of traditional legal culture can we embark on a path for Chinese modernization of the rule of law.
