摘要
2019年10月26日,山东大学在青岛举办了首届山大人权高端论坛:"人权的中国发展:历史、社会与法律"学术研讨会。与会者围绕人权的历史转型、社会理论中的人权功能、信息社会的人权与基本权利保护、基本权利的教义学构建、新兴(型)权利的理论与实践发展等重大问题进行了深入研讨。新中国成立以后,中国的人权事业得到了长足发展,中国特色社会主义的人权理论话语体系也已逐步形成。但是,有关"人权理论的中国化"的研究仍待进一步深入。为实现这一目标,探究现行人权保护机制背后更深层次的历史脉络和社会机制尤为重要,唯有如此,文本中的人权才能够真正鲜活起来,厚重的人权理论才能得到积淀。随着中国社会转型与社会整合的进一步加深,尤其是当下互联网和大数据的蓬勃发展,人权被赋予了新的功能。相应地,对人权的内容、性质、功能、保护机制等议题的研究也不应只囿于历史、现实、未来等传统维度,还应从社会的维度,结合中国的社会背景进行研究。
On October 26,2019,Shandong University held the first Shandong University high-end forum on human rights in Qingdao:"China’s development of human rights:history,society and law".The participants discussed the historical transformation of human rights,the function of human rights in social theory,the protection of human rights and fundamental rights in an information society,the construction of dogmatics of fundamental rights,and the theoretical and practical development of emerging rights.After the founding of the People’s Republic of China,China’s human rights cause has been significantly developed,and the discourse system of human rights theory of socialism with Chinese characteristics has gradually formed.However,the research on"the Chineseization of human rights theory"still needs further study.In order to achieve this goal,it is especially important to explore the deeper historical context and social mechanism behind the current human rights protection mechanism.Only in this way can the human rights in the text be genuinely alive,and the profound human rights theory can be accumulated.With the deepening of China’s social transformation and social integration,especially the vigorous development of the Internet and big data,human rights have been given new functions.Correspondingly,the research on the content,nature,function and protection mechanism of human rights should not only be limited to traditional dimensions such as history,reality and future.It should also be studied from the social dimension and the social background of China.
