The Practice Dilemma of Labor Relations and Social Security among Individual Workers on the Sharing Economy Platform

摘要共享经济在缓解社会就业压力、优化劳动资源配置的同时,深刻改变了传统劳动用工形式,使得共享经济平台个体经营者的社会保障由于用工关系难以认定而面临实践困境。本文在对共享经济平台个体经营者的概念和特征进行界定的基础上,梳理有关共享经济平台个体经营者用工关系认定的五种观点,提出"福利身份化"的社会保障制度与"去劳动关系化"的共享经济平台个体经营者用工关系之间的矛盾是引发社会保障实践困境的根源。建议明确共享经济平台个体经营者社会保障政策创新的主要思路,确定共享经济平台个体经营者社会保障模式和相关主体责任,优化社会保险参保缴费机制,填补社会保险政策空白,补足补充性社会保障项目短板,建立多维社会救助识别机制,改革社会保障服务管理方式,以更加灵活、更加适应新业态的社会保障制度创新回应共享经济平台个体经营者劳动权益保护的现实需要。 The sharing economy,while creating job opportunities and optimizing labor resource allocation,has also profoundly changed traditional forms of labor and employment.The social security of individual workers on the sharing economy platform is facing problems due to the difficulty in identifying the employment relationship.After def ning the concept and characteristics of individual workers in the sharing economy platform,this paper sorts out f ve perspectives on the identif cation of employment relationship of these individual workers,and puts forward that the social security schemes divided by population groups and ambiguous employee relationships on the sharing economy platform are the root causes of the problems regarding the workers’social security.In order to protect the labor rights and interests of these individual workers,more flexible and innovative social security measures are needed,including:(1)clarify the responsibilities of relevant stakeholders in providing social security;(2)improve the mechanism of participating in and contributing to social insurance;(3)fill in the gaps in social insurance policies;(4)improve supplementary social security schemes;(5)build multidimensional targeting mechanism for social assistance and(6)reform the ways of service and management of social security.
