摘要
加强暂予监外执行数字检察是新时代刑罚执行监督工作发展的必由之路。这项工作遵循以人为本的理念,坚持节点监督为主线和数字技术为支点的实践逻辑,解决了部分法律监督中存在的限缩性、滞后性、被动性的困境。但在司法实践中,暂予监外执行数字检察存在数据壁垒突出、数据资源利用不足、数字建设支撑不够等问题,未充分发挥技术赋能监督的功效。因此,应进一步优化多主体间数据协同模式,激活沉睡的数据,落实数字化建设的相关保障制度,推动暂予监外执行数字检察工作水平的提升。
Strengthening the digital prosecution of temporary execution outside prison is a necessary path for the development of the supervision of the execution of penalties in the new era.This work follows the people-centered concept,adheres to the practical logic of node supervision as the main line and digital technology as the fulcrum,and solves the dilemmas of limitations,lagging and passivity in some legal supervision.However,in judicial practice,the digital prosecution of temporary execution outside prison has problems such as prominent data barriers,insufficient utilization of data resources,and insufficient support for digital construction,and has not given full play to the efficacy of technology-enabled supervision.Therefore,we should further optimize the data synergy mode among multiple subjects,activate the dormant data,pay attention to the relevant guarantee system of digital construction,and promote the improvement of the level of the digital prosecution of temporary execution outside prison.
