摘要
人权保障原则应当成为应急管理立法遵循的法律原则。在应急状态下,人权保障原则对紧急权的制约不仅有与正常状态下相同的要求,基于应急状态下社会关系的特点,也表现为应急性原则、比例原则和核心基本权利不可克减原则等特殊要求。《突发事件应对管理法(草案)》增加了对社会各主体合法权益保护的规定,体现了对人权保障原则的贯彻。以人权保障原则视角审视,未来修改草案可考虑进一步完善体现应急性原则的规则,规范设计需充分体现比例原则和核心基本权利不可克减的人权理念。
The principle of human rights protection should be the legal principle followed by emergency management legislation.In the emergency state,the restriction of human rights protection principle on the emergency power not only has the same requirements as that in the normal state.Based on the characteristics of social relations in the emergency state,it also shows special requirements such as the principle of urgency,the principle of proportionality and the principle of non-derogability of core fundamental rights.The Emergency Response Management Law(Draft)adds provisions on the protection of the legitimate rights and interests of all social subjects,reflecting the implementation of the principle of human rights protection.From the perspective of human rights protection principles,the future revised draft can consider further improving the rules reflecting the principle of urgency,and the normative design should fully reflect the principle of proportionality and the concept of human rights that core fundamental rights are non-derogable.
