摘要
现代社会运行的复杂性和人口的高密集性导致影响公共安全的不利因素日益增多,完善应急管理体系、提升应急管理能力成为推进中国式现代化建设的当务之急。非常态化下应急管理公共政策制定的周期短,内容上表现为公权力扩张且缺乏稳定性,但应急管理公共政策仍应坚持制定法治化,这是全面推进依法治国、有效应对突发公共事件、平衡公权力和个人权利的必然要求。目前,应急管理公共政策的制定还面临应急管理立法不完善,信息的收集、公开与保护不规范,程序上缺乏公众参与等法治困境。为有效应对突发公共事件,提升国家治理能力,要尽快完善应急管理立法,将以人民为中心、保证公权力运行防止责任缺位、坚持比例原则以规范公权力行使等法治理念融入应急管理公共政策,尽快建立应急预案制度,信息收集、公开和保护制度并完善公众参与决策机制。
The complexity of modern social operation and the high density of population lead to the increasing number of adverse factors affecting public safety.Improving the emergency management system and enhancing the emergency management capacity have become the top priority to promote China’s modernization.The period of public policy formulation under emergency management is short.The content shows that the expansion of public power and the lack of stability,but public policies on emergency management must still be formulated in accordance with the law,which is an inevitable requirement for comprehensively advancing the rule of law,effectively responding to public emergencies,and balancing public power and individual rights.At present,the formulation of public policies for emergency management is still faced with legal difficulties such as imperfect emergency management legislation,irregular information collection,disclosure and protection,and lack of public participation in procedures.In order to effectively respond to public emergencies and enhance the national governance capacity,the emergency management legislation should be improved as soon as possible.We should adhere to the rule of law concepts such as putting the people first,ensuring the exercise of public power to prevent the absence of responsibility,adhering to the principle of proportion to standardize the exercise of public power.We should establish an emergency plan system as soon as possible,establish an information collection,disclosure and protection system,and improve the decision-making mechanism of public participation.
