摘要
将罪错未成年人作为一个整体对待,并根据其个性因素差别分级构建相应的处遇措施是实现未成年人司法制度向更加公平、高效、人道目标发展的必然要求。法国未成年人司法制度已有百余年的历史,并且在罪错未成年人的责任年龄、罪错行为的严重程度、罪错未成年人的处遇措施以及对罪错未成年人适用的诉讼程序等方面都建立了发达的分级制度。在充分借鉴其立法规定、相关经验和理论成果的基础上,我国未来在构建和完善罪错未成年人分级处遇制度时应当首先从正确理解和贯彻教育优先原则、确立罪错责任年龄、适时调整刑事责任年龄、完善针对未达刑事责任年龄罪错未成年人的保护处分措施这几个方面做起。
To treat juvenile delinquents as a whole and to construct corresponding treatment measures according to their individual personalities are the inevitable requirements to develop the juvenile justice towards a more fair,efficient and humane goal.French juvenile justice has a history of more than one hundred years,and has established a developed classification system based on the age of juvenile delinquents,the severity of criminal misconduct,the treatment measures of juvenile delinquents and the litigation procedures applicable to juvenile delinquents.Learning from the legislation,the practice and the theoretical achievements of juvenile justice in France,when constructing and perfecting the system of classified treatment of juvenile delinquents in the future,China should start with correctly understanding and implementing the principle of education priority,establishing the age of delinquent responsibility,timely adjusting the age of criminal responsibility,and improving the protective measures for the juvenile delinquent.
