摘要
罪错未成年人一体化教育保护体系的设立,体现了对罪错未成年人修复式教育理念的确立和整体性治理的政策转向。当前存在罪错未成年人教育保护的“碎片化”和教育修复效果不彰等问题。建议以修复式教育为目标,出台有关罪错未成年人教育保护的实施细则或办法,建立五位一体的罪错未成年人教育保护制度,包括科学的罪错分级处遇制度、多元化社会支持体系、普通教育与专门教育流转衔接机制、对失职家长的持续监督和多元化教育指导制度、信息共享互通制度。
The establishment of an integrated education and protection system for delinquent minors reflects the holistic govermance idea of the integration of education,correction,protection and prevention of delinquent minors.At present,there is a problem of“fragmentation”of the educational protection of delinquent minors and a lack of effectiveness in restorative education.It is recommended that with the goal of restorative education,the implementation rules or measures for the education and protection of delinquent minors shall be promulgated,and a five-in-one system for the education and protection of delinquent minors shall be established.It includes a scientific system for the classification and punishment of crimes and faults,a diversified social support system,a mechanism for the transfer and convergence between general education and specialized education,a system of continuous supervision and diversifed education guidance for derelict parents,and an information sharing and exchanging system.
